Terms of Service and Rewards Program Terms

These Terms govern your use of the Pet365 website, services, Pet365 Rewards Program, Referral Program, and Pet365 Store (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

The Service is currently offered to individuals who are at least 18 years old, reside in the United States, and can enter into a binding agreement. You must provide accurate, current information, maintain one account, protect your credentials, and promptly notify us of suspected unauthorized use. The Service currently supports dogs and cats.

2. Pet365 Is Not Insurance or Veterinary Care

Pet365 is a promotional pet wellness rewards platform. It is not an insurer, veterinary provider, healthcare provider, or reimbursement plan. Pet365 does not provide insurance coverage, veterinary advice, diagnosis, or treatment. Consult a licensed veterinarian about your pet's health.

3. Eligible Submissions

You may submit invoices, receipts, or care records for eligible pet care expenses. A submission must be authentic, legible, attributable to you or a pet in your account, and contain the information reasonably needed for review. Uploading a record does not guarantee approval or Points.

We review submissions for eligibility, completeness, duplication, and potential fraud. Final eligible expenses and Point awards are based on verified documentation and Program requirements. We may request additional information, reject ineligible or unverifiable submissions, correct errors, or reverse Points issued in error. A rejected submission does not prevent you from submitting corrected information where permitted.

4. Pet365 Reward Points

• After review and verification, members may earn 1 Pet365 Reward Point for each eligible dollar of verified care expenses.
• A maximum of 500 Points may be awarded per submission.
• Points are promotional incentives, not cash, currency, property, payment, or reimbursement. They have no cash value and cannot be sold, transferred, withdrawn, or exchanged for cash.
• Available Points may be redeemed only for eligible products offered in the Pet365 Store, subject to inventory, account status, shipping restrictions, and applicable redemption requirements.
• Product selection, Point requirements, and availability may change. Images, retail values, and examples are illustrative unless expressly stated otherwise.

5. Referral Program

An eligible new member who registers through a valid referral link or code receives 10 Pending Points. Pending Points are displayed in the member's account but cannot be redeemed. After that member's first eligible care record is approved, the 10 Pending Points become 10 Available Points and the referring member receives 20 Available Points.

Referral rewards are limited to single-level referrals. Self-referrals, duplicate or fabricated accounts, misleading promotion, spam, automated enrollment, and other abusive or fraudulent activity are prohibited. Each reward may be issued only once for an eligible referral. We may withhold, reverse, or cancel referral Points if eligibility cannot be verified or these Terms are violated.

Members who share referral links should clearly disclose that they may receive Points if the recipient qualifies. Referral Points are not cash compensation and have no cash value.

6. Store Redemptions and Fulfillment

Redemptions are subject to available Points, product inventory, quantity limits, shipping eligibility, and verification. We may cancel a redemption and restore the applicable Points if an item is unavailable or an order cannot be fulfilled. Product-specific return, replacement, or cancellation information will be provided where applicable.

7. Acceptable Use and Fraud Prevention

You may not submit false, altered, duplicate, stolen, or unauthorized records; manipulate the Service; interfere with security; scrape the Service without permission; impersonate another person; or use the Service unlawfully. We may investigate activity, request verification, limit access, suspend accounts, cancel redemptions, or forfeit improperly obtained Points when reasonably necessary to protect the Service and its users.

8. User Content

You retain ownership of content you submit. You grant Pet365 a nonexclusive license to host, process, reproduce, and display that content only as reasonably necessary to operate, secure, improve, and administer the Service and comply with law. You represent that you have the right to provide the content.

9. Third-Party Services

The Service may use third-party providers for hosting, data storage, authentication, analytics, communications, fulfillment, and payment-related functionality. Third-party services are governed by their own terms and privacy policies. Pet365 is not responsible for third-party services outside its reasonable control.

10. Program Changes, Suspension, and Termination

We may modify, suspend, or end the Service or a program feature, including eligibility rules, Point earning rates, caps, redemption requirements, and product availability. Where reasonably practicable, we will provide notice of material changes before they take effect. We may suspend or terminate an account for violations, fraud, abuse, legal requirements, or security risks. Rights that must survive termination by their nature will continue.

11. Disclaimers

TO THE EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." PET365 DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. NOTHING IN THESE TERMS LIMITS RIGHTS THAT CANNOT LAWFULLY BE WAIVED.

12. Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, PET365 WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE SERVICE. PET365'S TOTAL LIABILITY FOR A CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID PET365 FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR $100. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW.

13. Changes to These Terms

We may update these Terms. We will post the revised Terms with an updated effective date and provide additional notice when required by law. Continued use after the effective date means you accept the revised Terms.
